The Illinois Wrongful Death Act specifically provide that the victim’s surviving spouse and kin can recover damages for grief, sorrow, and mental suffering caused by the loss of the deceased. Likewise, a claim can be brought by the estate of the decedent for his or her Illinois wrongful death.

What the case is worth is up to the jury. But normal Illinois Wrongful Death Act cases are dependent upon a variety of factors including, but not limited to, the life expectancy of the deceased, the financial loss to the family of the deceased’s earnings, the pain and suffering of the heirs, the age and health of the deceased and heirs, and whether or not surviving family members were dependent upon the deceased for income for support.
